Terms of Service

1. Acceptance of Terms

By accessing or using the BidBinBuy platform — including our website, mobile apps, and any related services (collectively, the "Platform") — you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and BidBinBuy, LLC.

2. The Platform

BidBinBuy is a marketplace that connects buyers with independently operated liquidation bin stores. BidBinBuy is NOT a retailer and does NOT own, warehouse, or ship any of the items listed on the Platform. All transactions are between buyers and the individual store owners. BidBinBuy acts solely as a technology intermediary and is not a party to the purchase contract between buyers and store owners.

3. Accounts

• You must provide accurate, complete, and current information when creating an account.
• You are responsible for maintaining the security of your credentials. Do not share your password.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to create an account on BidBinBuy.
• You agree to notify us immediately at legal@bidbinbuy.com if you suspect unauthorized access to your account.

4. Store Owners

If you operate a bin store on the Platform, you agree to:

• Provide accurate and complete product descriptions, category information, and pricing.
• Honor all paid orders. Failure to fulfill a paid order may result in account suspension.
• Not list prohibited items (see Section 6).
• Pay all applicable platform fees as set out in your subscription plan.
• Comply with all applicable tax laws in your jurisdiction. BidBinBuy does not collect or remit sales tax on your behalf unless required by law.
• Ensure your listed items are legally owned and not subject to any lien, claim, or encumbrance that would prevent sale.

5. Buyers

• Exception — Item Not as Described: If an item is materially misrepresented (e.g., listed as "working" but is broken), contact the store owner within 48 hours of receipt or pickup. Resolution is at the store owner's discretion.
• Payment must be completed at the time of purchase.
• Pickup orders must be collected within 14 days of the order date. Orders not picked up within 14 days may be forfeited without refund at the store owner's discretion.

6. Prohibited Items

The following items may not be listed or sold on the Platform:

• Weapons, firearms, ammunition, and related accessories
• Controlled substances, prescription medications, or drug paraphernalia
• Counterfeit goods or items infringing intellectual property rights
• Stolen property or items obtained illegally
• Adult or sexually explicit content
• Items subject to export controls or international trade sanctions

BidBinBuy reserves the right to remove listings and suspend accounts at any time for suspected violations of this section.

7. Payments

• All payments are processed by PayPal. By making a purchase, you agree to PayPal's terms and privacy policy.
• Platform fees charged to store owners are non-refundable once processed.
• BidBinBuy Reward Points have no cash value, cannot be transferred between accounts, and expire after 12 consecutive months of account inactivity.

8. Intellectual Property

The BidBinBuy Platform, including its name, logo, design, software, and all associated branding, is owned by BidBinBuy, LLC and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent. By listing products on the Platform, store owners grant BidBinBuy a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute their product listings and associated images for the purpose of operating and promoting the Platform.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• BidBinBuy is not liable for the quality, accuracy of description, safety, or legality of any item listed by a store owner.
• BidBinBuy is not liable for any conduct, actions, or omissions of store owners or buyers.
• BidBinBuy is not liable for shipping delays, carrier errors, or lost packages.
• BidBinBuy's maximum aggregate liability to you for any claim arising from your use of the Platform is limited to the total fees you paid to BidBinBuy in the 30 days immediately preceding the event giving rise to the claim.

10. Dispute Resolution

We encourage you to resolve disputes using the following process:

1. First, contact the store owner directly through the Platform messaging system.
2. If unresolved, escalate to BidBinBuy Support at legal@bidbinbuy.com.
3. If still unresolved after 30 days, disputes shall be settled by binding arbitration administered by JAMS under its Streamlined Arbitration Rules.

Class Action Waiver: You agree to resolve disputes with BidBinBuy on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against BidBinBuy.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of [STATE], without regard to its conflict of law principles.

12. Termination

BidBinBuy reserves the right to suspend or permanently terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud, or otherwise acted in a manner harmful to the Platform, other users, or BidBinBuy, LLC. Termination does not affect any rights or obligations arising before termination.
